Why there is ONE KeyLand Application and not two
This is a single application for OUTLINE APPROVAL and has been validated as such. It is not a planning issue for the public or the Planning Committee.
The site naturally falls into two parts and there are different planning policies governing each part. However there is NO BENEFICIAL REASON either to split the application or to accepting it as one. Their choice has been to submit it as one application.

Benefits to Harrogate Borough Council
KeyLand has given a written undertaking to fully fund the ALL 43 Affordable housing units that this application generates. This represents 50% of the total number of 86 housing units. The Council has a 10 year span in which to take full advantage of all the funding for affordable housing that this application can provide.

KeyLand has given a written undertaking that the development of the Depot part will be built first.
This immediately provides Harrogate Borough Council with some Affordable family homes.

The Affordable Housing percentage can be varied and they can be built off site.
Harrogate Borough Council has asked for 50% of the total number of homes to be affordable homes. This percentage can be varied by negotiation 

50% of the total of 86 houses to be built means that 43 should be affordable homes. The Depot part, where there are no planning policy restrictions, will give rise to 25 of the Affordable homes. This represents 50% of the total number of the 51 housing units on the Depot part.

The balance of the 43 affordable homes not yet accounted for is 18. This represents 50% of the 35 homes on the Reservoir part of the application. These will require to be accommodated off site. They will be fully paid for by a commuted sum. This arrangement is possible when valid exceptional conditions exist as they do here and these are part of current planning policies. Government planning advice gives consent to allow off site commuted sums in lieu of actual housing on site.

Harrogate Borough Council must set out their demands on the where and how many affordable houses are to be built here so that everything is placed before the planning committee and the public at the time when this application is decided.


If ALL the Government planning advice and ALL the planning policies that cover the EVERY ASPECT of this application are observed, then the most beneficial result can be delivered to everyone involved – especially Harrogate Borough Council.
